General Terms and Conditions of Meama Köln GmbH

1. Scope

  1. These Terms and Conditions (“T&Cs”) apply to all orders placed via the online shop of Meama Köln GmbH, Erftstraße 15–17, 50672 Cologne, Germany.
    1.1. The product offerings are directed exclusively at buyers who are 18 years or older.
    1.2. All deliveries, services, and offers are based solely on these T&Cs. These also apply to future business relationships with companies, even if not expressly agreed again. Conflicting customer T&Cs are rejected in advance.
    1.3. Contract language is exclusively German.

2. Conclusion of Contract

2.1. Product presentations in the online shop are non-binding and do not represent a contractual offer.
2.2. By clicking "Order with obligation to pay," you submit a binding purchase offer (§ 145 BGB).
2.3. After placing the order, you will receive an automatic confirmation email. This is not an acceptance of your offer.
2.4. The contract is concluded only upon explicit acceptance (order confirmation) or dispatch of goods. In case of advance payment or PayPal, the contract is concluded upon order.
2.5. Orders are only possible in household quantities.

3. Prices

Prices include VAT and other price components but exclude shipping costs.

4. Payment Terms; Default

4.1. Payment methods:

  • Credit Card

  • PayPal

  • Klarna

  • Google Pay

  • Apple Pay
    4.2. We reserve the right to limit available payment methods.
    4.3. For credit cards, authorization occurs at order time, with the charge at shipping.
    4.4. For PayPal, payment follows immediately upon order confirmation.
    4.5. Klarna: invoice payment due within 30 days; subject to credit check.
    4.6. Google Pay uses a virtual account representing your card.
    4.7. Apple Pay uses stored card copies in Apple devices.

5. Offsetting; Right of Retention

5.1. Offset rights exist only with undisputed or legally established counterclaims.
5.2. Retention rights are only valid for claims from the same contract.

6. Delivery

6.1. Delivery is from our warehouse to your specified address.
6.2. Delivery only within Germany; island delivery excludes chilled/fresh items.
6.3. Partial deliveries are permitted if reasonable.
6.4. For perishable goods, you must ensure acceptance at delivery time.
6.5. Availability dependent. If out of stock, we notify and reserve the order.
6.6. We are not obligated to deliver if we ourselves were not properly supplied, unless at fault.

7. Retention of Title

7.1. Goods remain our property until full payment.
7.2. For business customers:

  • Ownership remains until all claims are settled.

  • Resale allowed; receivables are assigned to us.

  • In processing or mixing, we acquire co-ownership.

  • We will release securities if their value exceeds claims by over 10%.

8. Right of Withdrawal

8.1. Consumers (§ 13 BGB) have a statutory right of withdrawal.

9. Voluntary Return Policy for Machines

9.1. 6-month voluntary return right for machines, besides the legal right of withdrawal.
9.2. Return only if machine is undamaged, complete, and unused.
9.3. Return shipping costs are borne by you.

10. Transport Damage

10.1. Please report obvious shipping damage to the carrier and contact us promptly.
10.2. Failure to do so does not affect your legal rights but helps us with claims.

11. Warranty

11.1. Unless otherwise agreed, statutory warranty applies (§§ 433 ff. BGB).
11.2. For businesses:

  • Only our info and manufacturer's product description are binding.

  • Defects must be reported within 7 days of receipt.

  • Remedy by replacement or repair at our choice.

  • After two failures, you may reduce the price or withdraw.

  • Warranty period is 2 years from delivery.

12. Liability

12.1. We are fully liable for intent, gross negligence, and under product liability law.
12.2. Limited liability for slight negligence: only for essential duties, capped at foreseeable damage. Applies also to agents.

13. Gift and Promotional Vouchers

13.1. Redeemable in our online shop.
13.2. Gift Vouchers:

  • Available for purchase in various amounts.

  • Valid for 3 years, usable multiple times.

  • Cannot be exchanged for cash or used to buy other gift vouchers.

  • Transferable.
    13.3. Promotional Vouchers:

  • Issued via campaigns or shop.

  • Only valid for consumers.

  • Not valid for gift voucher purchases.

  • One per order, limited validity.

  • No cash value, no refund on returns.

14. Auto-Refill Terms

14.1. Buy ≥6 capsule packs as a subscription at discounted price.
14.2. Auto-payment by selected method.
14.3. Can cancel before next order. Legal rights remain unaffected.

15. “Try Meama Espresso Capsules” Offer (Germany)

15.1. Buy 10 espresso capsule packs via campaign page → get a free espresso machine (while supplies last).
15.2. Shipping free.
15.3. Limited to 50 machines, cannot be combined with other offers.
15.4. Full ownership upon payment and shipping.
15.5. No returns unless defective.
15.6. Consumers in Germany only. No resale.
15.7. Meama may modify or end the offer at any time.

16. “Meama Espresso Capsules Giveaway” (Germany)

16.1. 100 free capsule sets (3x packs) to be won.
16.2. Eligibility: adults in Germany, with:

  • Newsletter signup (double opt-in)

  • Following @Meama.de on Instagram

  • Providing full name + address
    16.3. Random draw after campaign ends. No cash equivalent.
    16.4. Winners contacted via email. No response in 7 days → replacement drawn.
    16.5. One entry per person. Manipulation = disqualification.
    16.6. No purchase required. Winners may be asked (not obligated) to review or tag Meama.
    16.7. Non-winners get a thank-you email and €10 welcome voucher.
    16.8. Meama may end/adjust the giveaway at any time.

17. Alternative Dispute Resolution

17.1. EU provides an online dispute resolution platform: http://ec.europa.eu/consumers/odr/
17.2. We aim to resolve disputes amicably but are not obligated to participate in mediation.

18. Final Provisions

18.1. If any clause is invalid, the rest remain effective.
18.2. German law applies; CISG (UN law) excluded. Consumer protections in your country still apply.
18.3. Jurisdiction for business customers is our registered office.
18.4. In case of inconsistencies between the German and English versions, the German version prevails.

19. “Try Meama Multi-Machine” Offer

19.1. Buy a bundle: Meama Multi-Machine + ≥5 capsule packs + 2 premium cups → pay €51.45 (instead of €275.44).
19.2. Includes potential free extras (no legal claim).
19.3. Limited to German consumers.
19.4. Returns within 14 days allowed if:

  • Machine is undamaged, in original packaging with accessories

  • Both premium cups included

  • All unused capsules returned (sealed, in pack)
    Customer pays return shipping.
    19.5. Not combinable with other discounts. No subscription. No resale.
    19.6. Meama may cancel/adjust the offer anytime
